HERITAGE LEGISLATION AND ADVICE

This is the area in which the Firm can claim to have the most experience and expertise of any firm in Australia. Advice, from Community consultation to drafting Heritage legislation, has been undertaken in every State and Territory of Australia as well as at the Commonwealth level. The legislation in Queensland, the Northern Territory, the ACT, New South Wales and Tasmania was essentially drafted by Peter James and advice has been provided on numerous occasions to the other jurisdictions. Advice on these issues has also been provided in a number of South East Asian Countries and the Firm is presently drafting a Heritage Act for Fiji – the first for that Country.

Another major contribution to conservation in Australia was made by Peter James when he first introduced the concept of Heritage Agreements in Australia and drafted the first Act – the South Australian legislation. Since then every State and Territory has introduced the concept of heritage (or conservation as they are sometimes called) agreements – in the cultural, Aboriginal and natural areas.
